Fraudulent Activity and Financial Liability Policy
1. Policy Purpose
This policy serves to formally establish the obligations and financial liabilities of clients engaging in fraudulent activities, or attempting to do so, through the services provided by PACE LOGISTICS CARGO, specifically in relation to the delivery and transport of vehicles.
2. Scope
This policy applies to all individuals, entities, or organizations (hereinafter “Clients”) who utilize or attempt to utilize the services of PACE LOGISTICS CARGO for vehicle transportation purposes.
3. Fraudulent Transactions
A “fraudulent transaction” shall include, but is not limited to, the use of false identities, misrepresented financial information, forged payment instruments, deceptive claims, or any other dishonest act intended to mislead PACE LOGISTICS CARGO, evade legitimate charges, or exploit the company’s services.
4. Joint and Several Liability
In the event of any confirmed or suspected fraudulent transaction, both the sender (hereinafter “Initiating Party”) and the recipient (hereinafter “Receiving Party”) shall be held jointly and severally liable for any and all costs, damages, and losses incurred by PACE LOGISTICS CARGO, including but not limited to:
• Investigative and administrative expenses
• Legal and enforcement-related costs
• Recovery and remediation fees
5. Proportional Responsibility
Notwithstanding the shared liability referenced above, the Initiating Party shall be held primarily responsible and shall be required to pay a greater percentage of the total assessed fees, as determined at the sole discretion of PACE LOGISTICS CARGO or any adjudicating authority under Vermont law.
6. Enforcement and Acceptance
PACE LOGISTICS CARGO reserves the right to pursue all available legal remedies to recover losses resulting from fraudulent transactions. Use of PACE LOGISTICS CARGO’s services constitutes the Client’s full and informed acknowledgment of, and agreement to, this policy and the liabilities set forth herein.
7. Governing Law
This policy shall be governed by and construed in accordance with the laws of the State of Vermont. Any disputes arising under or in connection with this policy shall be subject to the exclusive jurisdiction of the appropriate courts within the State of Vermont.
